Mobile Fidelity Sound Lab, Inc.
its subsidiaries and affiliates, ("MFSL") warrants each
cd-r during its lifetime against defective workmanship or materials,
and will replace any defective cd-r free of charge when returned
to a MFSL dealer or to MFSL, postage prepaid, at the address below.
If MFSL is unable to replace any defective product, it will refund
the purchase price. The use of solvent based permanent markers voids
this warranty as these types of markers corrode polycarbonate and
will etch away precious information and eventually will yield a
cd-r which is unplayable (USE ONLY WATER BASED MARKERS).
THIS IS MFSL’S ONLY WARRANTY AND MFSL MAKES
NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE REMEDIES
PROVIDED HEREIN ARE YOUR SOLE AND EXCLUSIVE REMEDY AND MOFI SHALL
NOT BE LIABLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES,
WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY. Some
states in the U.S.A. do not allow the exclusion or limitation of
incidental or consequential damages, so the above limitation of
exclusion may not apply to you. This warranty gives you specific
legal rights, and you may also have other rights which vary from
state to state and from country to country.
